Who we are
AVALONWEBVR is a a sub-branch of the Australian registered trade name AVALONWEB. Avalonweb was founded and owned by Mark Boyce. Marks role is that of a software developer and 3D Graphics Artist providing all services including website design and back-end server management.

Mark Boyce (The Owner) is not affiliated with COVD or any industry related to the treatment of any ailments described by the application or related documentation electronic or printed.
Equal-Eyes, Equal-Eyes Pro or any of its variants or support applications (The Application) are designed to serve as a visual therapy trainer to potentially aid in the improvement of 3D perception, strabismus, and amblyopia. It is important to note the following:

Not FDA Approved
The Equal-Eyes application has not been evaluated or approved by the Food and Drug Administration (FDA) for the treatment or diagnosis of medical conditions. Its use is not a substitute for professional medical advice, diagnosis, or treatment.

No Outcome Warranty
AvalonwebVr provides no warranties, expressed or implied, regarding the efficacy, accuracy, or outcomes resulting from the use of this application. Users acknowledge that the application is provided "as is" and use it at their own risk.

Terms and Conditions

Usage Guidance

Guidance from a Visual Eye Doctor (VTOD): It is strongly advised that this application is used under the guidance, supervision, and recommendation of a qualified Visual Eye Doctor (VTOD). The application should complement, not replace, any ongoing treatment, therapy, or medical advice provided by a licensed professional.

Server Outtages

From time to time, AvalonwebVr Cloud Servers for which some applications "may" depend for normal operation, could be down due to maintenance, system faults or power outtages. The application "may" operate in a limited capacity during this period. AvalonwebVr will not be held accountable for losses during this period of outtage and will endeavour to restore the server operation in a timely manner.

Headset Updates

From time to time, Your headset may receive a core operating system, or user-interface update from Oculus, Meta or other organisation. Should this update impact the AvalonwebVr application, AvalonwebVr will not be held liable. AvalonwebVr will endeavour to maintain compatibility with the new system in a timely manner.

Hardware issues

AvalonwebVr will not be held liable for The Application failure when being used on defective, rooted or non-standard headsets.

Software issues

The Application, although tested, may contain unexpected bugs. Should these become evident, AvalonwebVr will not be held liable. AvalonwebVr should be informed so that they may take action to resolve or remove the affected code. Should a bug fixed be deemed serious enough, a new version will be rolled out. Even though the bug may not effect you directly. You may be required to update your software to continue using it.

Installation

The Application will require installation through Side Loading using the third party SidequestVr application. It is the "users responsibilty" to enable Developer Mode and the correct installation of the SideQuest Application in order to install The Application. AvalonwebVr will not be held liable for installation issues.

Termination of Service

AvalonwebVr reserve the right to terminate operation of The Application should it be discovered that The Application has been obtained by dis-honest means, hacked, illegally distributed or reverse engineered.

Limitation of Liability

AvalonwebVr shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of this application, including but not limited to personal injury, loss of data, server outtage or any other harm or financial loss incurred.

Assumption of Risk

Users acknowledge and agree that the use of this application involves inherent risks, and they voluntarily assume any potential risks associated with its use.

BY USING THE APPLICATION, USERS ACCEPT AND AGREE TO THESE TERMS AND CONDITIONS. IF USERS TO NOT AGREE WITH THESE TERMS, THEY SHOULD REFRAIN FROM USING THE APPLICATION.

Data Privacy

Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment or use software that access our servers, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
